Article 1 — Operator
The FoolMoon platform is operated by FoolMoon UG (haftungsbeschränkt), a limited liability company under German law currently in the process of incorporation, with its registered office in Rheinau, Baden-Württemberg, Germany.
The HRB number (Handelsregisternummer) will be communicated and this document updated as soon as registration has been obtained.
Article 2 — Purpose
The FoolMoon platform is a SaaS service that enables organisers of private events to:
- Send invitations to their guests by SMS;
- Manage RSVPs and check-in via QR code;
- Share a post-event photo gallery.
These Terms and Conditions govern the contractual relationship between FoolMoon and any user accessing the service via foolmoon.app.
Article 3 — Access to the service
Access to the service requires registration via a mobile telephone number. The user undertakes to provide accurate information and to maintain the confidentiality of their access.
The Lune Noire plan is free of charge and available without commitment, subject to the quota conditions described on the page /tarifs. Paid plans (Croissant, Pleine Lune, Super Lune) are available by taking out a Stripe subscription.
Article 4 — Pricing
The prices in force can be consulted on the page /tarifs. They are expressed in euros (EUR) and constitute the final price inclusive of all taxes.
FoolMoon UG (haftungsbeschränkt) benefits from the Kleinunternehmerregelung regime within the meaning of § 19 UStG (the German VAT Act). As such, no VAT is charged on FoolMoon services. Stripe invoices do not include a separate VAT line.
This regime may be subject to change if the annual turnover of FoolMoon UG exceeds the applicable statutory threshold (25 000 € in 2026). Subscribed users would be informed with at least 30 days' notice.
FoolMoon reserves the right to change its prices at any time. Subscribed users are informed of any price change with at least 30 days' notice.
Article 5 — Termination
The subscription may be terminated at any time from the account administration area. Termination takes effect at the end of the current billing period: access to the plan's features remains active until that date, with no pro-rata refund.
In the event of termination, the organiser's data is retained for the periods specified for each plan (see /tarifs) and then permanently deleted.
Article 6 — Personal data
FoolMoon processes the personal data of users and their guests in accordance with the General Data Protection Regulation (GDPR / DSGVO). Please consult our privacy policy for details of the processing operations, processors and retention periods.
The data collected (telephone numbers, names, RSVPs) is used exclusively in the context of the service described in Article 2 and is never resold to third parties.
Article 7 — Governing law and jurisdiction
These Terms and Conditions are governed by German law (Deutsches Recht). In the event of a dispute that cannot be resolved amicably, the competent court is the court of Offenburg, Germany.
