Article 1 — Operator
The FoolMoon platform is operated by FoolMoon GmbH, a limited liability company under German law currently in the process of incorporation, with its registered office in Rheinau, Baden-Württemberg, Germany.
The HRB number (Handelsregisternummer) will be communicated and this document updated as soon as registration has been obtained.
Article 2 — Purpose
The FoolMoon platform is a SaaS service that enables organisers of private events to:
- Send invitations to their guests by SMS;
- Manage RSVPs and check-in via QR code;
- Share a post-event photo gallery.
These Terms and Conditions govern the contractual relationship between FoolMoon GmbH and any user accessing the service via foolmoon.app.
Article 3 — Access to the service
Access to the service requires registration via a mobile telephone number. The user undertakes to provide accurate information and to maintain the confidentiality of their access.
The Lune Noire plan is free of charge and available without commitment, subject to the quota conditions described on the page /tarifs. Paid plans (Croissant, Pleine Lune, Super Lune) are available by taking out a Stripe subscription.
Article 4 — Pricing
The prices in force can be consulted on the page /tarifs. They are expressed in euros (EUR) and exclude VAT.
Displayed prices exclude VAT. VAT at the applicable rate is added at payment and shown as a separate line on the Stripe invoice. The rate is determined by the customer's billing country.
Businesses established in another EU member state that provide a valid VAT number are invoiced without VAT, the tax being reverse-charged to them.
FoolMoon GmbH reserves the right to change its prices at any time. Subscribed users are informed of any price change with at least 30 days' notice.
Article 5 — Termination
The subscription may be terminated at any time from the account administration area. Termination takes effect at the end of the current billing period: access to the plan's features remains active until that date, with no pro-rata refund.
In the event of termination, the organiser's data is retained for the periods specified for each plan (see /tarifs) and then permanently deleted.
Article 6 — Personal data
FoolMoon GmbH processes the personal data of users and their guests in accordance with the General Data Protection Regulation (GDPR / DSGVO). Please consult our privacy policy for details of the processing operations, processors and retention periods.
The data collected (telephone numbers, names, RSVPs) is used exclusively in the context of the service described in Article 2 and is never resold to third parties.
Article 7 — Collection of guest payments
When the organiser enables online payment, guests' payments are collected directly on the organiser's own Stripe account, through Stripe Connect. FoolMoon GmbH has no access to this account and takes its commission on each payment. The organiser bears Stripe's fees. Opening this account requires accepting Stripe's terms and an identity check.
If an event is cancelled or a guest is refunded, the refund is taken from the organiser's Stripe balance, FoolMoon GmbH's commission included. If that balance is insufficient, it goes negative and Stripe recovers the amount from the organiser in accordance with Stripe's terms.
Article 8 — Governing law and jurisdiction
These Terms and Conditions are governed by German law (Deutsches Recht). In the event of a dispute that cannot be resolved amicably, the competent court is the court of Offenburg, Germany.
